Conditions of participation Cashback Competition
§ 1 General - Scope
These Terms and Conditions of Participation apply to participation in our Cashback Competition. The following Terms and Conditions of Participation apply exclusively and uniformly to participation in our Cashback Competition.
§ 2 Prize draw
01. - The prize draw is organized by Wickey Corporation,112 South Tryon Street, Suite 1130 28284-2109 Charlotte, North Carolina, USA.
02. - The prize draw is not limited in time.
03. - The prize for the winner(s) is a refund of 100% of the purchase price.
04. - The prize draw cannot be combined with other campaigns.
§ 3 Participation
01. - Eligible participants are natural persons who are legally competent and at least 21 years of age. Participating customers must have their permanent residence in the United States of America. Employees of Wickey Corporation and their family members are excluded from participation.
02. - Only customers of Wickey Corporation are eligible to participate. A prerequisite for participation is submitting a review on TrustPilot. The participating customer is directed Trustpilot via the Pop-up window. When submitting a review, the customer must provide the same name that they used when placing their order so that the review can be assigned accordingly. Registration for the prize draw is completed once the participating customer submits the review by clicking the button to upload the review.
03. - Wickey Corporation may exclude the participant from the prize draw without stating any reasons. Wickey is entitled to do so if the participant has provided inaccurate or incomplete registration data. In the event of a violation of these Terms and Conditions of Participation or a justified suspicion of such a violation by the participant, Wickey Corporation is entitled to exclude the respective participant with immediate effect. In such a case, Wickey Corporation is entitled to revoke any prizes already awarded and/or to demand their return.
04. - Each participant may only participate in the prize draw once.
§ 4 Process and procedure
01. - The winner(s) will be determined by random selection. The selection will be carried out using a digital tool that randomly selects a winner. The selection will take place each month.
02. - The prize is non-transferable.
03. - The winner(s) will be notified of their prize by Wickey by email in the middle of the following month.
04. - The winner(s) must contact Wickey Corporation within two weeks after the prize notification has been sent. If the winner(s) do not respond within two weeks of the prize notification being sent, the prize will be forfeited without substitution.
05. - The place of performance is the registered office of Wickey Corporation in 28284-2109 Charlotte, North Carolina, USA.
06. - The refund of the purchase price will be made using the payment method provided by the winner to Wickey after receiving the prize notification. If, for reasons attributable to the participating customer/winner, a transfer of the prize is not possible within two months after the prize notification has been sent, the prize will be forfeited without substitution.
§ 5 Participant Data
01. - The participant declares their consent that, in the event of winning, their name may be used and published by Wickey Corporation for marketing purposes.
02. - The participant expressly consents to photographs being taken of them on behalf of Wickey Corporation and published online for the promotion of the prize draw. They also consent to these photographs, together with the participant’s name, being made publicly accessible for self‑promotion by Wickey Corporation and being forwarded to the press as part of press work and reporting relating to the specific prize draw and/or prize draws of Wickey Corporation in general. This consent also includes the publication of the photographs and the participant’s name in print media and other media. The participant has no claim to publication of their name or the photographs. They are not entitled to any remuneration for publication of the data and photographs pursuant to this provision.
03. - The participant expressly agrees that Wickey Corporation may store their registration data for the duration of the prize draw and, in the event of winning, for the purpose of sending the prize and for publication under section (1).
§ 6 Rights and Obligations of Wickey Corporation
01. - Wickey Corporation does not carry out any verification of the registration data.
02. - Wickey Corporation is entitled to cancel the prize draw at any time. There is no obligation to provide participants with reasons for the cancellation. A cancellation may be considered if, for technical or legal reasons, proper execution of the prize draw can no longer be guaranteed. If the cancellation is caused by the conduct of a participant, Wickey Corporation may claim damages.
03. - In the event of a violation of these Terms and Conditions of Participation or a justified suspicion of such a violation by a participant, Wickey Corporation is entitled to exclude the respective participant.
§ 7 Liability
01. - The Wickey Corporation shall be liable without limitation for damages caused intentionally or through gross negligence by Wickey Corporation or by its legal representatives, senior employees, or simple vicarious agents.
02. - In cases of slightly negligent breaches of only insignificant contractual obligations, Wickey Corporation shall not be liable. In all other respects, the liability of Wickey Corporation for slightly negligent damages is limited to those damages that must typically be expected within the scope of the contractual relationship. This also applies in the event of slightly negligent breaches of duty by legal representatives, senior employees, or simple vicarious agents. The limitation of liability does not apply to claims arising from injury to life, body, or health, insofar as such injury is attributable to Wickey Corporation.
03. - All information is provided without guarantee. This applies in particular to the publication of the names of the winners.
§ 8 Data protection
The participants’ data will be processed in accordance with the applicable data protection laws.
§ 9 Final Provisions
01. - This Agreement, and all disputes arising out of or in connection therefrom, shall be governed by the Uniform Commercial Code and other applicable laws in effect in North Carolina on the effective date, including its choice of law provisions. The provisions of the United Nations Convention on the International Sale of GOODS shall not apply to this Agreement.
02. - Charlotte, North Carolina shall be the sole and exclusive jurisdiction and venue for any litigation, special proceeding, or other proceeding between the parties that may be brought or arise out of or in connection with or by reason of this Agreement.
03. - Should individual provisions of these terms of participation be wholly or partially invalid, the validity of the remaining provisions shall not be affected.
