§ 1 Scope of application
01. - These conditions of participation apply to participation in Wickey's Wickey X Poppyseed Play Giveaway. The following conditions of participation apply uniformly and exclusively to participation in Wickey's Wickey X Poppyseed Play Giveaway.
§ 2 Campaign
01. - The campaign is organized by Wickey Corporation, 112 South, Tryon Street, Suite 1130.
02. - The giveaway is in no way connected to Instagram and is neither sponsored, supported, nor organized by Instagram.
03. - The campaign is limited in time. The giving away starts on 2/16/26 and ends on 2/22/26 at 00:00. Entries submitted late will not be considered.
04. - The prize for the winner is a personalized coupon code in the amount of 500 §. The coupon code is valid for all play sets. The coupon code is valid for 7 days after receiving.
05. - The discount code cannot be combined with other discount codes, other competitions or promotions advertised via social media and Google.
§ 3 Participation
01. - Natural and legally competent persons over 21 years of age are eligible to participate. Participants must have their permanent residence in the USA. To participate, you must be a resident of one of the states in which Wickey delivers. Information on this is provided in the competition posting. Employees of Wickey Corporation and their family members may not participate.
02. - The condition of participation is that the participating user follows the Instagram account “wickey_usa” of Wickey Corporation and comments on the competition entry with the content specified in the competition entry. follows Wickey.
03. - Wickey Corporation may exclude the participants from the campaign without giving reasons. It is authorised to do so in particular in the event that the participant has provided incomplete data. In the case of violation of the participation conditions or reasonable suspicion of such a violation by the participant, Wickey Corporation is entitled to immediately exclude the participant in question. In this case, Wickey Corporation is entitled to refuse the prize and/or request its return as appropriate.
04. - Only one participation in the competition is possible per participant.
§ 4 Process and procedure
01. - The winner will be determined by drawing lots from all comments. The draw will take place within 3 days.
02. - The prize is non-transferable.
03. - The winner will be notified after the competition has ended and the prize draw has taken place. However, no later than 10 days after the prize has been drawn by Wickey by replying to his comment in the competition posting after the end of the competition.
04. - The winner must contact Wickey by direct message within 7 days of the notification of the prize having been sent. If the winner does not respond within 7 days of sending the notification of the prize, the prize will be forfeited without replacement.
05. - The winner must provide Wickey with all necessary information for the processing of the prize.
§ 5 Participant data
01. - The participant agrees that, in the event of winning, his/her name may be used and published by Wickey for marketing purposes and may be published.
02. - Participants provide explicit consent for photographs of them to be produced by Wickey and published online to advertise the campaign. Customers agree that these photos, in addition to the name of participants, may be published by Wickey and passed on to press agencies by Wickey within the scope of press releases and media coverage regarding the specific campaign in question and/or any campaign organised by Wickey The consent of participants refers to the publishing of images and customer names in printed media and other media forms. The participant has no right to the publication of his/her name or the pictures taken. He/she is not entitled to any kind of remuneration relating to the publishing of such data and images in line with this regulation.
03. - Participants explicitly consent to the saving of their registration data by Wickey for the duration of the competition and in the case of a prize win for the purposes of sending the prize as well as for publication as per paragraph 1.
§ 6 Rights and obligations of Wickey Coporation
01. - Wickey does not undertake any checks of registration data.
02. - Wickey is entitled to terminate the competition at any time. In the event of such termination, participants are not entitled to any reasons or explanations for cancellation. A competition may be cancelled if the proper execution of the event can no longer be guaranteed for technical or legal reasons. If cancellation of the competition is caused by a participant, Wickey may demand compensation.
03. - In the event of a breach of these conditions of participation or the justified suspicion of a breach by a customer, Wickey is authorised to exclude the respective customer.
§ 7 Liability
01. - Wickey is liable without limitation for damages caused by Wickey or by its legal representatives, executive employees or simple vicarious agents as a result of intent or gross negligence.
02. - In cases of slightly negligent breach of only minor contractual obligations is not liable. Aside from this, the liability of Wickey for damages caused by slight negligence is limited to those damages that can typically be expected to occur within the scope of the service relationship. This also applies in the case of slightly negligent breaches of duty by its legal representatives, executive employees or simple vicarious agents. The liability limitations do not apply in the case of personal injury, injury to health, or the death of the participant, if this can be attributed to Wickey.
03. - All information is provided without guarantee. This refers in particular to the publication of the name of the customer.
§ 8 Data protection
01. - Wickey Corporation shall handle the registration data of participants confidentially and shall only make this data available to third parties to the extent that this is permitted by data protection law, is necessary for the realisation of the campaign and the sending of the discount code, or the registrant provides his/her consent.
02. - Please note that Wickey Corporation processes customers' personal data electronically. Data will be used solely for the realisation of the competition and for advertising in accordance with § 5, unless otherwise agreed.
§ 9 Legal recourse
There is no legal recourse.
§ 10 Final provisions
01. - SUBJECT TO APPLICABLE LAW, THE REMEDIES SET FORTH ABOVE ARE CUSTOMER'S SOLE AND EXCLUSIVE REMEDIES AND WICKEY'S ENTIRE OBLIGATION AND LIABILITY FOR ANY BREACH OF ITS LIMITED WARRANTY. SUBJECT TO APPLICABLE LAW, UNDER NO CIRCUMSTANCES WILL COMPANY'S OBLIGATION OR LIABILITY HEREUNDER EXCEED THE PURCHASE PRICE CUSTOMER PAID FOR ANY GOODS. ADDITIONALLY, SUBJECT TO APPLICABLE LAW, UNDER NO CIRCUMSTNACES WILL THE COMPANY BE LIABLE FOR ANY LOSS OF USE, DATA, BUSINESS GOODWILL, REPUTATION, OR REVENUE, AND/OR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES OR OTHER DIRECT OR INDIRECT LOSSES OF ANY KIND.
§ 11 Final provisions
01. - The laws of the Federal Republic of Germany shall apply. For consumers concluding a contract for neither professional nor commercial purposes, these laws shall only apply in as far as protection provided by mandatory provisions of the law in the country in which the consumer usually resides has not been revoked. The provisions of the UN Sales Convention (CISG) shall not apply.
02. - If the participant does not have a general place of jurisdiction in Germany or if their place of residence or habitual abode is unknown at the time the action is brought, the exclusive place of jurisdiction for all disputes arising under this contract shall be the place of business of Wickey.
03. - Should individual provisions of these terms and conditions of action be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
